VISITOR TERMS AND CONDITIONS

  • World Trade Expo – Handloom festival is an exhibition brand under registration with World Trade Center Mumbai.
  • The Exhibitors are Artisans, Weavers, Designers, Government Organisations, Merchant Exporters, NGOs. World Trade Center Mumbai or IAMKHADI, do not have any authority over its exhibitors for assurance of delivery of goods or services as displayed or committed by them.
  • The Handloom Festival is an international virtual exhibition, organised to showcase and market products through virtual catalogues, brochures and videos, and to build up network and contacts and for setting up B2B meetings.
  • All visitors are required to pre-register in order to gain entry. The Organisers will record details in a secure database in order to keep a record and generate statistics and mail, email or SMS information about the handloom festival and future editions.
  • Visitors will not promote their products or services to exhibitors while attending the virtual handloom festival. Visitors found in breach of this rule may be asked to leave the event immediately and be refused entry to future shows.
  • Visitors will not photograph or video or make digital images of any products without prior consent from the exhibitor or the Organizers. Visitors found in breach of this rule may be asked to leave the event immediately and be refused entry to future shows.
  • The visitor understands the intricacies of an online exhibition platform in terms of products displayed by exhibitors. The colour, texture, nature or size etc may be different from physical ones. The visitor is expected to make a detailed inquiry and understand before any financial transaction.
  • World Trade Center Mumbai shall not be responsible for any transactions happening over the platform in form of business, service, or products delivery. The visitor must do his independent research on the authenticity of each exhibitor products & services.
  • World Trade Center Mumbai is only facilitator of organising the online exhibition & the visitor understands that all communication done by him with the exhibitor is at his own discretion and judgment.
  • The visitor warrants indemnity to World Trade Center Mumbai, its sponsors, associate partners, and all other supporting partners in case of any legal issue between the visitor and exhibitor. We reserve the right to change any event schedules & agendas without notification due to unforeseen circumstances.
  • Visitors are aware of terms and condition of online payment & associated risks of the same.
  • World Trade Center Mumbai reserves the right to amend these terms and conditions (without notice) from time to time and the visitor will be subject to the terms and conditions in force at the time that the Festival is hosted.
  • These terms and conditions are governed by Indian law. Any disputes under or in connection with these terms and conditions shall be subject to the exclusive courts of Mumbai.

EXHIBITOR TERMS AND CONDITIONS

  • Exhibitor must submit a Booking Request in an electronic from or in any other manner as acceptable by World Trade Center and submit the same.
  • Exhibitor must be jointly and severally being liable under these Terms with any agent appointed to make the Booking on their behalf.
  • World Trade Center Mumbai shall be responsible for the development and setup of the festival, the Website and the Platform.
  • Exhibitor shall be responsible for the setting up of their own profile and technical requirements that would be necessary for using the link to the Website provided by World Trade Center Mumbai and to participate in the festival via the Platform.
  • Exhibitor shall be responsible for creating, clearing and providing Content to World Trade Center Mumbai for the event. A detailed development and production timeline for the Event, including provision of the Content and all obligations, will be agreed between the Exhibitor & World Trade Center Mumbai. If Exhibitor fails to respond in a timely manner or otherwise fail to comply with the agreed timeline, World Trade Center shall be under no obligation to change the dates of the Event or any pre-Event marketing campaigns.
  • Exhibitor will grant World Trade Center Mumbai a non-exclusive, royalty free, worldwide licence solely in connection with the development, production, marketing, promotion and hosting of the Event and the archiving there of to use, reproduce, digitise, publish, display, exhibit, distribute, transmit and otherwise broadcast (itself or on its behalf) Your name and Your Content in relation to (and before, during and after) the Event.
  • Exhibitor will not undertake to create or introduce into the Event, the Website, the Platform or any part there of any known spyware, virus, Trojan horse, logic bomb or other destructive or contaminating program; and will comply with all relevant data protection laws and legislations in respect of privacy and personal data.
  • World Trade Center will not be responsible for:
    • any equipment or service failure where such equipment or service is not within the sole control of World Trade Center;
    • any network failure or incompatibility; or
    • any occurrence or event outside the reasonable control of World Trade Center;
  • World Trade Center reserves the right in its absolute discretion to terminate access to the link to the Website in the event the exhibitors or its employees whose presence likely to be undesirable without prejudice to any other rights or remedies available to World Trade Center
  • The Fee shall be payable to World Trade Center into their nominated bank account in full and in cleared funds into within seven (7) days of the date of invoice. The Fee is stated exclusive of VAT/GST, which will be due at the prescribed rate as at the date of the invoice.
  • If payment of the Fee in full is not received before the Event, World Trade Center, may refuse entry to the Event. No refunds of any proportion of the Fee paid (if any) will be made.
  • World Trade Center, may cancel an Event at any time for any reason and shall in such event reimburse the Fee and shall have no other liability.
  • If the Exhibitor wishes to cancel the Booking, the same shall be notified in writing atleast 30days prior to the Event.
  • World Trade Center, shall have the right to terminate any Booking :-
    • Incase of failure to make any payment due by the due dates specified in these Terms; or
    • Incase of breach of these Terms or failure to comply with any material obligations or warranties under any agreement between the parties to which these Terms apply and in either case You do not remedy the same (if capable of being remedied) within three (3) days of receipt of notice in writing from De Ideaz Pte. Ltd specifying the breach or failure
  • Exhibitor shall defend, indemnify and hold World Trade Center, harmless from and against all costs, claims, demands, proceedings, liability, losses and expenses (including reasonable legal fees) whatsoever made against or incurred by World Trade Center as a result of, related to or arising in connection with (i) a breach of these Terms by You, and/or (ii) any acts or defaults of You, your employees or agents in connection with the Event and/or (iii) any claim brought against World Trade Center that the Content or any services or software supplied shall infringe, violate, or trespass or constitute the unauthorized use or misappropriation of any intellectual property of any third party.
  • The Festival is delivered over the Internet, and accordingly, is subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications. World Trade Center. shall not be responsible for any delays, delivery failures, viruses, hacker intrusions or other damage resulting from such problems.
  • World Trade Center makes no representation, warranty, or guarantee as to the reliability, timeliness, quality, suitability, truth, availability, accuracy or completeness.
  • World Trade Center shall not be liable for any loss, injury or damage to persons or property at the Event any actual or alleged indirect loss or consequential loss howsoever arising suffered by the Exhibitor, or any loss of profits, anticipated profits, savings, loss of business revenue, loss of business, loss of opportunity, loss of goodwill, or any other type of economic loss (whether direct or indirect).
  • Neither party shall be liable to the other in respect of any non-performance of its obligations by reason of any act of God, civil war or strife, act of foreign enemy, invasion, war, satellite failure, legal enactment, governmental order or regulation, industrial action, trade dispute, lock-out, riot or any other cause beyond their respective control provided always that in any such event the duration of the agreement between the parties shall be extended over which such event continues.
  • Exhibitor may not assign or transfer any rights or obligations under these Terms to any third party without prior written consent of World Trade Center.
  • Should any dispute arise between the parties hereto or at any time during the currency of this event or whensoever there after, the same shall as soon as the dispute shall arise, be referred to arbitration at Mumbai Jurisdiction by one Arbitrator to be appointed by both the parties hereto and in the event of disagreement between the parties, to two Arbitrators, one each to be appointed by each party and of an Umpire to be appointed by such two Arbitrators and such Arbitrators/Umpire shall be entitled to hear the parties orally, peruse the records produced before him/her/them and decide the matter summarily without recording any format evidence in a summary manner
